Creator Tax & Compliance Policy

FansStack provides online technology and platform services that allow creators and fans to interact, communicate, and conduct transactions. FansStack is not a tax advisor, accountant, tax preparer, or legal advisor to creators.

This policy explains the tax and compliance responsibilities of creators using FansStack and describes the tax-related tools and information that FansStack may make available to help creators maintain appropriate records and work with their own tax professionals.

Creators are responsible for understanding and complying with the tax laws and reporting requirements that apply to their own businesses, activities, income, sales, services, content, and transactions. FansStack does not assume a creator's tax obligations merely by providing the platform.

Scope of This Policy

This policy applies to creators who use FansStack to publish, monetize, sell, promote, or otherwise provide content, services, subscriptions, communications, or other offerings to fans.

This policy addresses tax and compliance responsibilities associated with creator activity on FansStack. It does not replace the FansStack Terms of Service, Creator Terms, Refund Policy, Payment Policy, Privacy Policy, or any other applicable FansStack policy.

1. Creator Tax Responsibility

Each creator is responsible for determining which taxes, registrations, licenses, filings, reporting requirements, and recordkeeping obligations apply to the creator's business and activities.

Depending on the creator's circumstances and jurisdiction, these obligations may include income taxes, business taxes, sales taxes, use taxes, gross receipts taxes, value-added taxes (VAT), goods and services taxes (GST), digital-services taxes, withholding requirements, or other taxes and government charges.

Creators are responsible for obtaining professional advice when necessary and for complying with the laws applicable to their business.

2. Income & Business Taxes

FansStack does not determine or pay a creator's income or business taxes on the creator's behalf unless a specific legal requirement expressly requires otherwise.

A creator's earnings, business expenses, platform fees, refunds, payment processing costs, and other financial activity may have tax or accounting consequences. Creators are responsible for maintaining appropriate records and reporting their income and deductible expenses as required by applicable law.

FansStack's platform fee is compensation for FansStack's technology and platform services. FansStack is responsible for its own applicable taxes and reporting obligations associated with FansStack's own revenue.

3. Sales, Use, VAT & GST Taxes

Creators are responsible for determining whether the goods, services, content, subscriptions, memberships, messages, or other offerings they provide through FansStack are subject to sales tax, use tax, VAT, GST, or similar transaction taxes.

Where applicable law places responsibility for registration, collection, reporting, or remittance of a transaction tax on the creator, the creator is responsible for satisfying those obligations.

FansStack may provide technology that assists with tax calculations, transaction records, reporting, or other compliance activities. The availability of such tools does not transfer the creator's legal tax responsibilities to FansStack.

Tax treatment can vary based on the creator's location, the fan's location, the type of offering, the nature of the transaction, the creator's tax registrations, and applicable local law.

FansStack does not represent that every creator transaction is taxable or non-taxable. Creators are responsible for obtaining appropriate professional advice concerning their own tax obligations.

4. Tax Registration & Permits

Where a creator is required to register for a tax account, sales-tax permit, VAT registration, GST registration, business registration, or similar authorization, the creator is responsible for completing and maintaining that registration.

Creators should monitor changes in their business activity, customer locations, transaction volume, and applicable thresholds that may create new registration or filing requirements.

FansStack may provide general educational resources or links to external tax authorities and professional service providers, but does not guarantee that a creator's registration status is correct.

5. Transaction Records

FansStack may maintain transaction records associated with activity on the platform. Depending on the features available, creators may be able to access or download records showing information such as:

  • Transaction dates.
  • Transaction amounts.
  • Creator earnings or proceeds.
  • FansStack platform fees.
  • Payment processing amounts or fees, where available.
  • Refunds or adjustments.
  • Applicable transaction-tax information, where available.
  • Transaction or jurisdictional information supported by the platform.

Creators are responsible for reviewing their records and maintaining any additional books, receipts, invoices, registrations, or documentation required by their tax authorities.

6. Tax Tools & Resources

FansStack may offer or integrate optional tools designed to help creators organize and understand transaction information for accounting and tax compliance purposes.

These tools may include transaction reports, downloadable records, jurisdictional summaries, tax calculation functionality, exportable data, educational materials, or integrations with third-party tax and accounting services.

Tax tools are provided as technology and informational resources. They are not a substitute for professional tax advice and do not guarantee that a creator has satisfied all tax obligations.

7. Accountants & Tax Professionals

Creators may wish to work with a qualified accountant, CPA, tax attorney, enrolled agent, or other tax professional who understands the creator's business and the jurisdictions in which the creator operates.

FansStack may provide creators with general resources or referrals to independent tax professionals or tax-service providers, including resources intended for creators operating in the United States.

Any accountant, CPA, attorney, tax preparer, or other professional referred to or identified through a FansStack resource is an independent third party. FansStack does not provide or guarantee the professional's advice, services, qualifications, filings, or results.

8. Payment Processing & Platform Fees

FansStack may use third-party payment processors and payment infrastructure to facilitate transactions between creators and fans.

FansStack's platform fee represents compensation for FansStack's technology and platform services. The platform fee is separate from any sales tax, VAT, GST, or other transaction tax that may apply to a creator's underlying offering.

Depending on the payment method and transaction structure, creator proceeds may be settled directly to the creator through the applicable payment infrastructure rather than being held by FansStack and subsequently paid to the creator.

Creators remain responsible for understanding the tax and accounting treatment of their earnings and transactions, including transactions processed through third-party payment providers.

9. Payment Processing Provider Accounts

FansStack may allow creators to connect accounts with third-party payment processing providers to facilitate payments for the creator's offerings through the FansStack platform.

Where a creator connects a payment processing provider account, that account is the creator's account and is maintained by the creator in accordance with the applicable provider's terms, requirements, and procedures.

Creators are responsible for providing and maintaining accurate business, identity, taxpayer, payment, and other information required by the applicable payment processing provider.

Creators are also responsible for reviewing and configuring their connected payment processing provider account and any available tax settings in accordance with their applicable tax obligations.

FansStack may provide technical integration functionality that allows transaction information to be exchanged between FansStack and a connected payment processing provider. The existence of that integration does not transfer the creator's tax obligations to FansStack.

A creator's use of a connected payment processing provider account does not, by itself, determine whether the creator is required to register for, collect, report, or remit any particular tax.

10. Tax Information Requests

Depending on applicable law and the payment or financial services used, FansStack or its service providers may request tax-related information from creators.

Such requests may include information needed for identity verification, payment processing, regulatory compliance, information reporting, or other legally required purposes.

Providing tax information to FansStack or a third-party service provider does not mean that FansStack is assuming responsibility for the creator's tax filings, tax payments, registrations, or other tax obligations.

11. Jurisdictional Requirements

FansStack is an online platform that may be accessible to creators and fans in different countries and jurisdictions. Tax laws differ substantially between jurisdictions and may also change over time.

A creator may have tax obligations in one or more jurisdictions depending on factors such as residence, business location, customer location, transaction volume, registration status, the type of offering provided, and applicable local law.

Creators are responsible for determining where they are required to register, collect, report, or remit taxes.

Nothing in this policy is intended to determine the tax residency, permanent establishment, nexus, taxable presence, or tax registration status of any creator.

Where applicable law expressly requires FansStack or one of its payment or service providers to collect, withhold, report, or remit a particular tax or government charge, FansStack or the applicable provider may do so as required by law.

12. No Tax or Legal Advice

FansStack provides technology, platform functionality, transaction information, and educational resources. FansStack does not provide individualized tax, accounting, or legal advice to creators or fans.

Creators should consult a qualified tax or legal professional when they need advice regarding their specific circumstances, including whether they must register for or collect sales tax, VAT, GST, or other transaction taxes.

Creators are solely responsible for evaluating and acting upon advice received from their own professional advisers.

13. Changes to This Policy

FansStack may update this policy from time to time to reflect changes in platform functionality, payment providers, tax technology, legal requirements, or operational practices.

When appropriate, FansStack may provide notice of material changes through the platform or other reasonable communication channels.

Document updates may be made from time to time to reflect operational, legal, tax, or policy changes.
